Now that summer hiring season is here, we thought it would be helpful to you to reissue a past Client Alert advising on the test to determine which persons may be hired as unpaid interns. The U.S. Department of Labor's Wage and Hour Division has set out a six-part test for determining whether a person may participate in an internship program without compensation. If you can satisfy all six parts, then you proceed with the internships, which may be held by citizens and non-citizens alike.
