"Court Sides With Developer When it Comes to Brownfield," an article by Environmental partner Charles S. Warren and associate Kerri B. Folb appeared in the March 3 issue of Real Estate Weekly. The article focused on a recently issued Court of Appeals decision for real estate owners and developers in New York State, stating that the New York State Department of Environmental Conservation abused its discretion in denying acceptance of two parcels of real property located in Monroe County into the Brownfield Cleanup Program. The decision should make it easier for applications to be accepted into the program.
