I’m Adequately Protected; Now What? Measuring Diminution Value

The April 2014 issue of the Americn Bankruptcy Institute Journal features an article co-authored by Bankruptcy and Restructuring partner Gregory A. Horowitz and associate Joseph A. Shifer entitled “I’m Adequately Protected; Now What? Measuring Diminution Value.” The article focuses on the issue of “adequate protection” as it was contested in the Residential Capital LLC Chapter 11 cases, and the insight the ResCap dispute provides as to the nature and extent of secured creditor rights after adequate protection is granted.
