On March 3, 2009, Kramer Levin client Sirius XM Radio Inc. scored a victory when The Word Network ("TWN"), the plaintiff in a long-running lawsuit against Sirius, voluntarily withdrew its case. In August 2007, the U.S. District Court for the Southern District of New York rejected as insufficient charges of racial bias brought by TWN, a white-owned venture in Detroit with a largely African American audience. Sirius had declined to renew TWN’s three-year contract after TWN came in near last – out of 100 Sirius broadcasters – in the ratings every period. Undeterred, TWN went back to court with a motion to amend its complaint, setting off a round of hotly contested litigation. In August 2008, Kramer Levin filed its brief opposing the motion or seeking summary judgment, in the alternative. Before the judge could rule, TWN withdrew its motion, calling off the suit.
