On November 21, 2013, Kramer Levin hosted a seminar entitled "Catch the Trend: Life Insurers, Private Funds and Capital Requirements – Issues & Insights " at the firm's New York offices.

Two interrelated areas in the insurance sector have been under increased regulatory and journalistic scrutiny recently — life insurance company capital, and fund acquisition and ownership of insurance businesses. This seminar explored the following:

  • Alleged abuses caused by certain kinds of captive reinsurance structures;
  • Developments in this space from the standpoint of insurers, funds, regulators and others;
  • Recent actions by the NAIC and state insurance departments that pose challenges for securitizing or otherwise monetizing insurance reserves;
  • Risks for private funds acquiring insurers; and
  • Opportunities and observations on how to navigate these choppy waters.
