Material Adverse Change Trends -- Quantitative Alternatives: Breathing Life into a Paper Tiger
On September 14 the New York Law Journal published a special report entitled "GC New York Guide: Business Practices" which includes an article by Corporate partner Howard T. Spilko and Corporate associate Joshua R. Little. In the article, Mr. Spilko and Mr. Little discuss their views on material adverse change trends towards the use of quantitative metrics and courts' signals relating to the acceptance of such metrics.
