An article written by Land Use partner Paul D. Selver and land use associates Elizabeth F. Larsen and Adam B. Taubman entitled “RLUIPA and Land Use: An Overview and a Closer Look at the 'Equal Terms' Provision and the Southern District's Third Church Decision” has been published in Environmental Law in New York. Part 1 of the article, which appeared in the November 2009 edition of the newsletter, discusses the background and enactment of the Religious Land Use and Institutionalized Persons Act of 2000 (RLUIPA), as well as how courts have interpreted the statute’s land use provisions. Part 2 of the article, which will appear in the December 2009 edition of the newsletter, discusses the Southern District's recent interpretation and application of the "equal terms" provision of RLUIPA in Third Church of Christ, Scientist, of New York City v. City of New York.
