The Summer 2012 issue of Swiss Derivatives Review includes an article by Corporate associates Fabien Carruzzo and Matthew A. Weiss entitled “Regulated Swap Entities under Dodd-Frank.” The article focuses on the CFTC and SEC’s recent adoption of final rules establishing which swap entities will be subject to stringent regulations imposed by the Dodd-Frank Wall Street Reform and Consumer Protection Act. The authors provide an overview of the swap dealer definition, the de minimis exemption and other applicable exclusions, as well as a summary of the applicable major swap participant criteria and an examination of various issues related to the definition of eligible contract participant.
