Third Circuit Upholds FTC’s Cybersecurity Authority

This alert highlights the recent United States Third Circuit Court of Appeals decision: FTC v. Wyndham Worldwide Corp. The decision affirmed a district court opinion holding that the Federal Trade Commission (“FTC”) has enforcement power over corporate cybersecurity practices pursuant to Section 5 of the FTC Act.
