Transborder Data Transfers and the Domino Effect of the Schrems Case
In the wake of the European Court of Justice’s Schrems decision, Ireland’s Data Protection Commissioner recently announced its intention to seek declaratory relief in the Irish High Court, as well as referral to the ECJ, to determine the legal status of data transfers under Standard Contractual Clauses. This alert discusses the likelihood of such a referral, and considers the broader implications of a potential decision by the ECJ on Standard Contractual Clauses for international data transfers.
