Corporate Restructuring and Bankruptcy partner Adam C. Rogoff's article "What Happens When Hospitals Are Sick?" appeared in the September 27, 2010 issue of The New York Law Journal. The article focuses on the impact the economic and financial crisis has taken on hospitals and health care providers, what happens when a hospital enters bankruptcy, as well as the special provisions The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 provides for health care cases. The provisions relate to patient record disposal, patient transfers to other health care facilities, the appointment of a patient care ombudsman and an exception to the automatic stay of the Secretary of Health and Human Services.
