• Linda Xu advises on intellectual property and commercial matters, bringing her technical and economic backgrounds to her work helping clients in litigation, risk analyses and the development of IP portfolios. Linda counsels clients on IP portfolio management, trade secrets and contracts in connection with various strategic transactions.

    Linda litigates in federal and state courts and before administrative tribunals, including the U.S. Patent and Trademark Office and the International Trade Commission. Among her most recent litigation work, Linda was a key member of a trial team that won one of the biggest verdicts in the history of patent litigation. She was also a member of the litigation team that obtained a favorable settlement for a cybersecurity company in a patent infringement case related to computer network technologies.

    In addition to her litigation practice, Linda has handled a large number of U.S. and international patent applications involving electrical, computer and medical technologies. She has also advised clients regarding IP due diligence and various types of agreements related to social media, supply chain, joint venture and government contracts.

    • Represented an artificial intelligence-focused company in drafting and negotiating contracts with customers.

    • Represented a social media company and a technology-based news company in their customer contracts, advertising agreements, privacy policies, website terms of use and copyright matters.

    • Represented a drinkware company in negotiating supply agreements with a major beverage company.

    • Represented software companies in drafting and negotiating service agreements and IP and data licenses, and reviewing open-source licenses.

    • Represented a fiber optics company in negotiating contracts with the U.S. government.

    • Represented a major credit bureau in IP due diligence in connection with its M&A and investment deals.

    • Part of the trial team that secured a $151.5 million verdict for Centripetal Networks Inc. in a patent infringement trial in the U.S. District Court for the Eastern District of Virginia.

    • Represented a medical device company to secure a favorable settlement in a trademark infringement and unfair competition suit.  

    • Represented a cybersecurity company in a patent infringement suit, with over $2 billion in damages awarded following a bench trial.

    • Represented a threat intelligence company in obtaining a favorable settlement in a patent infringement suit.

    • Represented a mobile solutions company in obtaining a successful settlement in a patent infringement suit.

    • Represented a U.S. computer security company in a Section 337 investigation before the International Trade Commission.

    • Represented a software company in defending allegations of trade secret misappropriation.

    • Represented an exercise equipment and media company in successfully defending multiple patent infringement cases, as well as claims regarding breach of contract and false advertising.

    • Represented various computer technology and software companies before the Patent Trial and Appeal Board.
