The FTC and FDA continue to take action against companies making deceptive claims that their products can prevent or treat COVID-19. First, the FTC recently issued an order barring Mark Ching, the marketer for dietary supplement Thrive, from making false COVID-19 treatment and prevention claims regarding the Vitamin C-based supplement. The order also requires Ching to send written notices to customers and retailers of the product explaining that it will not treat, prevent, or reduce the risk of COVID-19.  Second, the FDA and FTC issued joint warning letters to Health Beauty Love for its herbal tincture products, including “E-Mutiny;” and Kegan Wellness for its “She Vitamin C Tablets,” “She+ Tablets”, and “Giloe+ Tablets.”  The letters instruct the recipients to immediately cease making the unsupported claims and respond to the agencies with specific steps taken to address their concerns.
