Dr. Hu is a member of Kramer Levin’s Intellectual Property Group. His practice primarily involves patent litigation, patent prosecution, IP portfolio management and IP due diligence for name brand and generic pharmaceutical companies, as well as for chemical and telecommunications clients. He is experienced in freedom to operate opinions, patentability opinions, and technology transfer and licensing agreements.

His practice also involves general corporate matters for Chinese clients.

Representative cases include:

  • Purdue Pharma L.P. et al. v. Varam, Inc. et al. (S.D.N.Y & E.D. Pa.) – Defending Varam, Inc. and KVK-Tech, Inc. in an ANDA patent litigation relating to oxycodone hydrochloride extended release tablets.
  • Graceway Pharm., LLC, et al. v. Perrigo Co., et al. (D.N.J.) – Defended Nycomed US Inc. in a patent infringement action relating to imiquimod cream, 5%, prevented Graceway’s attempts in obtaining a Temporary Restraining Order and a Preliminary Injunction.
  • Medicis Pharmaceutical Corporation v. Nycomed US Inc. et al. (S.D.N.Y & D. Del.) – Defended Nycomed US Inc. in an ANDA patent litigation relating to Fluocinonide cream, 0.1%.
  • Nycomed US Inc. v. Glenmark Generics & Perrigo Co. (E.D.N.Y.) – Represented Nycomed US Inc. in ANDA patent litigations against generic manufacturers relating to Fluticasone Propionate Lotion, 0.05%.
  • Animal Science Products, Inc. v. China Minmetals Corp. et.al. (D.N.J.) – Defended Sinosteel Corp., Sinosteel Trading Co. and Liaoning Jiayi Metals & Minerals Co., Ltd. in class action antitrust lawsuit alleging price fixing for magnesite, resulting in dismissal of the complaint and amended complaint asserted by plaintiffs.
  • Katz Tech. v. XM Satellite Radio (C.D. Cal.) – Defended XM Satellite Radio in a patent infringement action relating to automatic voice response systems, resulting in a favorable settlement.
  • Keystone Autonics Inc. v. Sirius XM Radio Inc. (E.D. Tex.) – Defended Sirius XM Radio in a patent infringement action relating to over-the-air activation of radio devices brought by a “non-practicing entity” in the U.S. District Court for the Eastern District of Texas, resulting in “walk-away” stipulation of dismissal by plaintiff patentee after a decisive claim construction ruling.
  • Savient Pharmaceuticals Inc. v. Barr Labs., et al. (D.N.J.) – Represented Savient Pharmaceuticals in an ANDA patent litigation relating to oxandrolone, resulting in a favorable settlement.
