• Inge Hindriks advises and represents developers, property owners, lenders and investors in real estate development and construction, facilitating cost- and time-efficient site development for office, retail, hotel, community facility and mixed-use developments in New York City. In particular, Inge handles sales and acquisitions of development (or air) rights and the assemblage of zoning lots; she has closed more than 100 development rights transactions. Her work involves resolving issues at every phase of a project, including drafting and negotiating key—and often unique or novel—agreements, documents and solutions to avoid obstacles during the construction. To maximize the potential of a development and its operation, Inge drafts shared services agreements, covenants, restrictions, easements and declarations, as well as instruments and easements as may be required by governmental agencies in connection with the permitting process. She regularly serves as co-counsel with, or is consulted by, leading transactional real estate attorneys and law firms, as well as title companies, on complex issues.

    In the predevelopment phase of projects, Inge’s work involves a comprehensive range of matters, including the assemblage of zoning lots and the acquisition of development (air) rights to enable developers to maximize the development on a site, whether based on as-of-right development rights transfers or transfers from landmarks, theaters or other special transfer mechanisms. She also negotiates private agreements with property owners, such as the conveyance of cantilever and other rights, and a variety of other easements and agreements that enable the construction of a designed project. In connection with obtaining New York City agency approvals, permits for the project and land use approvals, Inge drafts and negotiates agreements and declarations including restrictive declarations, easements and parking agreements. She also advises and assists in the subdivision, merger or reconfiguration of tax lots to accommodate a development and the creation of air space parcels to enable certain development rights transactions. Inge works closely with Kramer Levin’s Land Use department, as well as with architects, engineers, surveyors, expediters and other development professionals.

    In the development phase of projects, Inge negotiates a wide variety of instruments and agreements, including private arrangements and agreements with various city and state agencies, such as subway improvement and relocation agreements with the Metropolitan Transit Authority (MTA)/New York City Transit Authority (NYCT), regulatory agreements with the New York City Department of Housing Preservation and Development, and agreements for the purchase of inclusionary certificates. Inge works with developers on both single-development sites and projects that are part of merged zoning lots or large-scale developments. A substantial part of her work consists of negotiating complex sitewide easement agreements or shared facilities agreements, including in connection with multiple developments on a zoning lot or a campus consisting of multiple buildings. She also negotiates construction license agreements — both with adjoining property owners to allow construction activities to take place and with governmental agencies for projects that involve land or water owned by New York City or New York State.

    Inge regularly crafts innovative solutions to complex or unusual title issues, such as when there are boundary issues or when strips or gores are discovered. She also resolves title issues with the City of New York and the MTA in connection with condemnation proceedings, working with the firm’s Condemnation team on related litigation and the payment of condemnation awards. Clients and colleagues in the firm’s Litigation department consult with her regarding disputes and potential litigation over matters including construction licenses, party or retaining walls, adverse possession, quiet title and encroachment issues.

    She also collaborates with the Condominium team on the development of high-profile complex commercial condominiums for mixed-use developments in Manhattan, including advising on easements, development rights reservations and allocation, as well as resolving issues related to authority under condominium documents or operating agreements. Her notable projects include the development of Hudson Yards and the redevelopment of the James A. Farley Post Office Building.

    Inge also dedicates significant time to pro bono work, providing guidance as well as drafting, reviewing and negotiating key agreements and other documents for numerous organizations, including the Friends of +POOL, the Universal Hip Hop Museum, the Coalition for the Homeless, Harlem Academy and Poets House.

    • Advised the Friends of +POOL, assisting the organization with various construction and consultants’ agreements for the pilot program to build a floating swimming pool in the East River.

    • Advised the Universal Hip Hop Museum, assisting the Bronx-based organization with construction and design documents related to the interior build-out of the brand-new museum space.

    • Advised the Coalition for the Homeless, providing assistance with a number of matters, including requirements related to public funding reviewing the New York Economic Development Corp. (EDC) and related restrictive declaration and other issues related to the property owned by the coalition.

    • Advised Harlem Academy on the development and construction of a new school, the resolution of construction and title issues, and the negotiation of access agreements with neighbors.

    • Advised Poets House on the sale of the remainder interest in property under a bequest.
