Insurance and Reinsurance

As the insurance industry—already roughly 14 percent of the nation’s GDP—continues to grow in size and complexity, our Insurance group has grown accordingly. We represent major corporations, insurance companies, and reinsurance companies in a variety of insurance-related matters.

Our principal areas of focus include:

  • Corporate and financial transactions involving the insurance and reinsurance industries
  • Insurance-related structured finance and alternative risk transfer
  • Insurance litigation
  • Insurance and reinsurance products
  • Insurance industry restructuring and insolvency

In the litigation of a wide range of coverage disputes, our lawyers are known for their legal acuity in the courtroom, having notably achieved early victory for both insurers and insureds —through motion to dismiss or summary judgment —in a number of high profile cases.

In addition to litigation, we regularly advise both corporations and insurance companies on the intricacies of directors and officers (D&O) liability coverage. We represent clients involved in M&A transactions, often in connection with the design, issuance, and review of representation and warranty policies. And we advise insurance companies on the creation and marketing of new products, especially those that require prior regulatory approval.

Our transactional and regulatory expertise in the insurance sector is widely recognized. With our partner Steven Goldman, former New Jersey banking and insurance commissioner, as well as a number of other seasoned practitioners in insurance M&A, capital markets, reinsurance and other disciplines, Kramer Levin offers a depth and sophistication in this field (including in related fields such as investment management, derivatives, securities and others) matched by few of our peers.
