Mr. Shifer’s practice focuses primarily on corporate restructuring and bankruptcy matters. Mr. Shifer’s restructuring experience includes representing chapter 11 debtors, official creditors’ committees, ad hoc creditor groups, noteholders, plan proponents, distressed investors, and other estate constituencies and fiduciaries. Mr. Shifer has been involved in matters relating to a diverse range of industries including financial, retail, automotive, manufacturing, mining, healthcare, and gaming.
Recent debtor matters include:
- Bally Total Fitness Holding Corp. – Assisted Bally, one of the largest operators of fitness centers in North America, in its reorganization pursuant to which the company eliminated more than $700 million in structured financial debt.
- Ascendia Brands, Inc. – Assisted Ascendia, the manufacturer of numerous well-known consumer brands such as Binaca and Mr. Bubble, in the orderly disposition of its assets.
Recent creditor matters include:
- Capmark Financial Group, Inc. – Represented the Official Committee of Unsecured Creditors.
- Magna Entertainment Corp. – Represented the Official Committee of Unsecured Creditors and ad hoc group of noteholders.
- ASARCO LLC – Represented majority noteholders.
- Dana Corp. - Represented the Official Committee of Unsecured Creditors.
Prior to attending law school, Mr. Shifer served as district legislative director to Congressman Edolphus “Ed” Towns (NY-10) from 2001 to 2004.
