Ms. Folb's practice concentrates in matters arising under federal, state and local environmental laws and regulations.

Ms. Folb litigates claims relating to the adequacy of environmental reviews under the New York State Environmental Quality Review Act and New York City's implementing regulations, as well as claims arising under state and federal hazardous substances laws and claims relating to land use laws and regulations. Ms. Folb reviews and negotiates environmental agreements in connection with corporate and real estate transactions, and conducts environmental due diligence. Ms. Folb also advises clients as to environmental impact review requirements, permitting and reporting obligations.

Representative matters on which Ms. Folb has assisted include the representation of Forest City Ratner Companies in multiple litigations challenging the environmental review and use of eminent domain to enable the development of the Atlantic Yards project, Solow Development in a litigation challenging the rezoning of the former Con Edison properties on First Avenue, the Museum of Modern Art in a lawsuit challenging its expansion, a community group in its challenge to the environmental review and siting of a New York City waste transfer station, a leading insurance company in connection with its underwriting of mergers and acquisitions insurance products, and the official committees of unsecured creditors of General Motors and Chrysler LLC in connection with environmental issues arising in their bankruptcy proceedings.
