Developments Regarding Section 316(b) of the Trust Indenture Act
Laurence Pettit regularly advises issuers and financial advisors on structured finance transactions involving a wide range of asset classes. Since January 2008, Mr. Pettit has worked on term and warehouse securitizations involving residential mortgage servicing advance receivables, private student loans, structured settlements, diversified payment rights, unsecured consumer loans, tobacco settlement payments, tobacco settlement fee awards, whole loans to life sciences companies, PACE bonds, and trade receivables. Mr. Pettit’s practice also involves counseling investment funds in their secondary market activity in ABS and MBS products, including distressed investing and workouts. In addition to U.S. transactions, his recent securitization work includes offerings backed by assets originated by companies and banks located in Turkey, Russia, the UK and Japan. He also represents clients in cross-border debt capital markets transactions, which in recent years have included tier 2 capital notes, extendible liquidity notes, commercial paper and medium-term notes for issuers based in Curacao, Portugal, Nigeria and Turkey. Mr. Pettit has also been involved in significant work in the project finance area supporting the construction of power generation facilities and toll roads. He also has experience practicing in Istanbul, where he was based for four years in the 1990s.
