Mr. Abbott is a member of Kramer Levin’s Intellectual Property Group. His practice primarily involves litigation matters, focusing on intellectual property as well as general commercial disputes. His litigation experience includes false advertising, trademark and trade secret actions, as well as complex patent infringement actions in various industries.

Representative Litigation Matters 

  • Advance Magazine Publishers Inc. v. Active8Now (S.D.N.Y.) - Defending publishing giant Condé Nast in litigation against a former vendor asserting patent infringement, trade secret and trademark claims. Obtained narrow claim construction leading to stipulation of non-infringement on all patent claims. 

  • Bracco Diagnostics, Inc. v. Amersham Health, Inc. (D.N.J.) - Representing a pharmaceutical industry plaintiff in false advertising litigation involving a 39-day trial with dozens of fact and expert witnesses, resulting in one of the largest false advertising damages awards on record as well as broad injunctive relief. 

  • Opti, Inc. v. Advanced Micro Devices, Inc. (E.D. Tex.) - Defending a chipset manufacturer against charges of patent infringement. 

  • Nycomed US Inc. v. Glenmark Generics Ltd. (E.D.N.Y.) - Representing patentee in litigation under the Hatch-Waxman Act.
  • Nycomed US, Inc. v. Tolmar, Inc. (D.N.J.) - Representing patentee in litigation against generic drug manufacturer under the Hatch-Waxman Act.
  • Consumer Satellite Radio, Inc. v. Sirius XM Radio, Inc. (E.D. Tex.) - Defending Sirius XM Radio in a patent infringement action relating to interoperable satellite radio receivers.
  • Triangle Software, LLC v. Garmin Int'l, Inc. et al. (E.D. Va.) - Representing Volkswagen Group of America in a patent infringement action relating to vehicle navigation systems.

Mr. Abbott’s pro bono practice involves representation of clients seeking asylum in the United States after fleeing persecution based on ethnicity, religion or sexual orientation. Mr. Abbott has successfully obtained asylum for clients from Colombia, Chad, Tibet, Cote d’Ivoire, Grenada and Jamaica. Additionally, Mr. Abbott has advised a number of pro bono clients on transactional issues concerning music copyrights.
