Litigation special counsel Michael Martinez was quoted a Wall Street Journal article about the balance prosecutors need to maintain between making their case and not overwhelming a jury. One of the cases highlighted in the article was the second trial of former Cendant Corp. chairman Walter Forbes, which Martinez worked on while he was Assistant United States Attorney in the District of New Jersey. Martinez was quoted as saying that they had to keep their case simple so it would make sense to the jury. He also said that while prosecutors should spend more time trying to cut back on the amount of evidence presented, time and resource constraints often do not allow for that.
