Transfer of Development Rights: What’s New – and What Is Not

An article written by Land Use Co-Chairs Paul D. Selver and Michael T. Sillerman  and Land Use associate Robin A. Kramer entitled “Transfer of Development Rights: What’s New – and What Is Not” appeared in the August 24, 2009 issue of the New York Law Journal.  The article discusses development rights transfers in NYC, describes the procedures necessary for such transfers, and explains why a recent Department of Finance memorandum on air rights subdivisions does not generally apply to such transfers.
