On November 29, 2005 Kramer Levin secured the dismissal of a consumer class action filed in the Southern District of Florida against client Procter & Gamble Company. The purported class consisted of the millions of people who use Head & Shoulders and Pantene hair care products. The suit pressed the novel legal theory that P&G had failed to warn consumers that its products were being counterfeited, and sought a host of remedies including medical monitoring and damages. The core allegation was that P&G continued to advertise its products knowing that those advertisements would cause some consumers to unwittingly purchase contaminated counterfeit products. In response to P&G's motions to dismiss and for sanctions, the Court not only dismissed the case with prejudice, but ordered plaintiffs' counsel to show cause why they should not pay sanctions and be barred from practicing in the Florida Federal courts.
