Marco Plankensteiner is a partner within Kramer Levin Europe and is based in Kramer Levin’s Paris office. He focuses his practice on competition/antitrust, distribution and consumer protection law. With a solid experience in French and EU competition law (cartels, abuse of dominant position, State aid), he assists our clients in dawn raids and antitrust investigations and defends them in proceedings before the French and European competition authorities, and in competition litigations before French courts, including complex damage claim litigations. For instance, he successfully defended Credit Agricole and LCL in various antitrust proceedings relating to multilateral interbank fees and Trodat France in a proceeding for abuse of dominant position before the French competition authority, as well as an Austrian district heating company in a follow on damage claim antitrust litigation. Marco Plankensteiner has a strong practice in merger control with EU and national competition authorities on both a national and community level, and regularly coordinates complex multijurisdictional filings on a global scale. He is also experienced in distribution and commercial law and assists our clients in the negotiation and termination of cooperation agreements (R&D, joint production and commercialization, joint ventures, supply, subcontracting) and distribution agreement (selective distribution, franchise networks, commercial policies, commercial agency) and in the related litigations, including proceeding relating to restrictive practices initiated by the DGCCRF. He advises our clients in advertising and consumer law (distance selling, e-commerce, cross-merchandising, comparative advertising …) and was involved in several unfair commercial practice and unfair contract terms cases. Marco Plankensteiner also assists and defends our clients in trademark, copyrights and unfair competition cases. While he represents clients in a wide variety of industries, his practice focuses most particularly in the sectors of banking, construction, agrifood, chemicals, fashion and consumer goods. Marco Plankensteiner is admitted to practice in Paris and Milan and assists regularly Italian and French companies in cross border investments and commercial relations. Native German speaker, he also assists German and Austrian companies in France. He teaches competition law at the University of Paris I (Panthéon-Sorbonne), and is a member of the AFEC, the French Association for the Study of Competition. He is author or co-author of several articles in antitrust and distribution law. Mr. Plankensteiner is ranked by Décideurs Stratégie Finance Droit 2016 as a highly recommended lawyer (forte notoriété) in Competition law, Antitrust and is recommended as having a highly regarded practice (pratique réputée) in Competition/Distribution law as well as in Luxury Fashion.
