Richard L. Moss
Special Counsel

Mr. Moss has extensive experience in U.S. and foreign patent prosecution in the electrical, electromechanical, general mechanical, computer software and business process technology areas, as well as in conducting patentability, infringement, and validity analyses. Mr. Moss’s practice also involves representing and counseling clients in intellectual property litigation matters, and in business transactions involving intellectual property assets, including licensing and corporate due diligence matters.

Over the years, Mr. Moss’s varied responsibilities at Kramer Levin have included: 

  • Managing U.S. patent prosecution activity for a leading global supplier of safety and control systems for commercial vehicles. 
  • Obtaining a favorable Markman patent claim construction ruling in the defense of a leading magazine publisher in patent infringement litigation in New York federal court -- resulting in a judgment of non-infringement. 
  • Successfully defending a leading satellite radio provider in patent infringement litigation in Texas federal court involving data transmission technology. 
  • Successfully litigating design patent infringement and unfair competition claims for the U.S. plumbing products division of a leading manufacturer of consumer and commercial bath and kitchen fixtures in New Jersey federal court, which involved obtaining a preliminary injunction and settling the case while on appeal to the U.S. Court of Appeals for the Federal Circuit -- resulting in a permanent injunction and payments to the client. 
  • Successfully defending a European furniture design/manufacturing company against design patent infringement claims in New York federal court -- obtaining a summary judgment ruling of non-infringement. 
  • Representing a leading children’s apparel manufacturer in numerous trademark licensing transactions involving iconic and celebrity brands. 
  • Conducting intellectual property due diligence for representations and warranties insurance solutions for the mergers and acquisitions insurance group of a leading international insurance company. 
  • Assisting the e-commerce business unit of an international banking conglomerate in negotiating a Statement of Work (pursuant to a Master Purchase Agreement) and a Software License Agreement with a leading global information services provider in connection with the client’s initiative in the area of smart cards. 
  • Serving as temporary acting in-house intellectual property counsel for a client -- a major U.S. consumer products manufacturer.
