• Lee Turner Friedman litigates complex commercial disputes and antitrust claims, and advises and represents companies in both internal and government False Claims Act investigations and in qui tam lawsuits. She has litigated in federal courts around the country and in the Superior Court of the District of Columbia.

    Lee’s work spans a wide range of industries and legal issues and has included price-fixing and monopolization claims in the agricultural and pharmaceutical industries; First Amendment challenges to a food labeling law; internal and government False Claims Act investigations and qui tam lawsuits for companies in the defense sector; False Claims Act and securities law claims related to a health care company’s hospital admission practices; and breach-of-contract, tort and employment disputes in the insurance, financial and real estate investment sectors.

    In addition to her trial work in state and federal courts around the country, Lee has briefed and argued numerous appeals in the 2nd, 5th and 6th circuits and in the District of Columbia Court of Appeals. On behalf of a pro bono client, she obtained a full reversal by the DC Court of Appeals of criminal convictions based on a stop and search of a car that violated the Fourth Amendment.

    Experience

    • Representing a real estate investment firm in a negligence suit filed in DC Superior Court against a neighboring developer and construction firms to recover for significant property damage and related losses arising from a catastrophic structural collapse.

    • Defended a Fortune 500 insurance company in multiple breach-of-contract and fraud class actions concerning premiums for workers’ compensation insurance.

    • Represented an asset management company seeking to recover $100 million in unpaid fees for services rendered to a telecommunications company.

    • Obtained summary judgment on behalf of a global pharmaceutical manufacturer on antitrust claims by a competitor seeking billions of dollars on allegations related to the client’s rebate agreements with pharmacy benefit managers.

    • Obtained the dismissal of all antitrust claims brought against a manufacturer of fire safety systems by a terminated distributor.

    • Represented direct-purchaser plaintiffs in an antitrust class action alleging that producers and trade groups conspired to restrict the domestic supply of eggs and egg products.

    • Obtained summary judgment on all claims against a Fortune 500 company in a qui tam lawsuit alleging that the company earned excess profits in connection with a contract with the U.S. Department of Homeland Security.

    • Prevailed on an initial motion to dismiss and subsequently obtained the dismissal with prejudice of False Claims Act allegations against the largest military shipbuilding company in the United States related to the building of aircraft carriers and Virginia-class submarines built for the U.S. Navy.

    • Assisted a major defense contractor in connection with multiple civil False Claims Act investigations by the U.S. Department of Justice, U.S. attorneys’ offices and other federal agencies.

    • Defended a Fortune 500 health care company against a $900 million securities class action and derivative shareholder action premised on alleged violations of the False Claims Act.

    • Obtained full reversal by the DC Court of Appeals of a client’s armed robbery conviction on the ground that the stop of a vehicle in which client was a passenger violated the Fourth Amendment.

    • Secured the compassionate release from federal prison under the First Step Act of 2018 of a 64-year-old pro bono client whose serious health conditions placed him at a heightened risk of catching and suffering severe illness from COVID-19.

    • Defended a genetically modified organism (GMO) labeling law against constitutional challenges brought under the First Amendment and Commerce Clause.
