Agency: A New Frontier for FCPA Jurisdiction

Litigation partners Darren LaVerne and Michael Martinez and associate Eric H. Rosoff authored a New York Law Journal article titled “Agency: A New Frontier for FCPA Jurisdiction” on Jan. 30, 2020. The article examines the implications of the government’s recent use of the common-law concept of agency as a jurisdictional predicate under the Foreign Corrupt Practices Act, including the exposure U.S. companies potentially face for the actions of their subsidiaries and agents overseas.
