Litigation partner Jeffrey S. Trachtman was interviewed by Bloomberg Big Law Business in an article titled “LGBT Rights Lawyer on Why Not to Despair after SCOTUS Rejects Bathroom Case,” on March 7, 2017.

The interview focused on the Supreme Court’s decision to not hear arguments in Gloucester County School Board v. G.G. – a landmark transgender rights case in which a Kramer Levin team, led by Mr. Trachtman, filed an amicus brief on behalf of more than 1,800 individual faith leaders in support of Gavin Grimm. The case concerned the application of Title IX to protect transgender students, but following the Trump administration’s roll back of the Obama-era guidance on the rights of transgender students, the Court declined to hear the case. Mr. Trachtman stated that Gavin’s case has nevertheless already done much to raise the profile of and promote acceptance of transgender individuals in American society.

Mr. Trachtman also discussed other briefs Kramer Levin has filed on behalf of religious institutions in support of LGBTQ rights – including those in United States v. Windsor, in which the Supreme Court struck down part of the Defense of Marriage Act, and Obergefell v. Hodges, which recognized same-sex couples’ constitutional right to marry – and the fallacy of arguments that recognizing LGBT civil rights is somehow inconsistent with religious freedom.
