Bankruptcy and Restructuring associate Kelly E. Porcelli’s article “Finality of Section 363 Sales in the Face of an Upset Bid,” appeared in the summer 2016 edition of the American Bankruptcy Institute Law Review. The article examines the different approaches courts have utilized when determining whether to reopen an auction and proposes that bankruptcy courts do so only when some procedural impediment exists.
