Darren Cohen, Peggy Farber, and Becky Porath have obtained an order of withholding of removal for a gay Jamaican man with HIV. Violence against gay people in Jamaica is pervasive and often takes place with the participation or knowing acquiescence of government officials. Individuals with HIV are more likely to face life-threatening discrimination and persecution. Our client faced insurmountable legal obstacles to asylum and therefore additionally applied for withholding of removal and withholding of removal under the Convention against Torture. To be granted withholding of removal, an applicant must meet a higher standard than for asylum. The Immigration Court found that our client met the higher standard, recognizing that he would almost certainly meet persecution and physical violence if removed to Jamaica.
