It is the third in a series of articles that address issues raised by managing asymmetrical litigations, or David versus Goliath situations, and the strategies for how to handle them effectively and efficiently.

The article focuses on strategies for structuring discovery to minimize its costs when it cannot be avoided altogether. The authors discuss the importance of the Joint Case Management Report in controlling discovery and why it should address and attempt to limit a defendant’s ESI obligations; how defendants should consider stipulating or conceding certain factual issues in exchange for either avoiding or severely limiting discovery on those issues; and why defendants may wish to seek a fact discovery period that is as short as practically possible.
