Intellectual Property partner Mark Baghdassarian and associate Aaron Frankel’s article “Litigation: Managing Joint Defense Groups in Asymmetrical Litigation” appears on InsideCounsel.com. It is the last in a series of articles that address issues raised by managing asymmetrical litigations, or David versus Goliath situations, and the strategies for how to handle them effectively and efficiently.

The article focuses on issues raised in multi-defendant actions, which present special challenges and opportunities for Goliath-sized defendants in asymmetrical litigation against small, non-practicing plaintiffs. The authors emphasize the importance of properly managing multiple defendants in order to leverage the strengths of the Goliaths and offer strategies for doing so, including pooling resources to avoid inflating, rather than reducing, costs; using shared counsel, if possible; and entering into a joint defense/common interest agreement.
