  • Kramer Levin's litigation-focused Intellectual Property team regularly asserts and defends IP-related claims in courts throughout the United States and Europe and before the U.S. Patent and Trademark Office as well as the European Union Intellectual Property Office and foreign national intellectual property agencies. Well known for our success in the courtroom, including in many high-stakes patent litigation cases, we also advise clients on worldwide IP portfolio management and IP-based transactions. Our team covers all aspects of electrical, computer and mechanical technologies as well as large- and small-molecule pharmaceuticals.

We employ a unique blend of legal acumen, business orientation, technical knowledge and litigation focus that fosters creative thinking and exploration of alternative theories. This approach often has a decisive impact on case outcomes and has contributed to our remarkable record of successes in the areas of cybersecurity, biotechnology, pharmaceuticals, computer hardware and software, telecommunications, and medical devices.

Our IP team takes a creative, proactive approach to every assignment, meeting challenges with practical solutions and helping our clients leverage opportunities through strategic licensing transactions, creative alliances and technology transfers.

    Our principal areas of focus:

    • Patent Litigation
    • Post-Grant Proceedings
    • Patent Prosecution and Counseling
    • Licensing Agreements and Corporate Transactions
    • Trademarks, Copyrights and Unfair Competition

Whether we are called on to serve as counselor, warrior, peacekeeper or problem-solver, we focus on responding to our clients’ needs, removing barriers to their success, and helping them protect and optimize the value of their intellectual property.

    Defining Matters

    • Kramer Levin Secures Largest Patent Judgment Ever Against Cisco Systems in First Ever Virtual Federal Trial

On Oct. 5, 2020, Kramer Levin won a major patent litigation case on behalf of Centripetal Networks Inc. in U.S. District Court for the Eastern District of Virginia. The Court found that Cisco Systems Inc. willfully and egregiously infringed four Centripetal patents and awarded Centripetal $1.9 billion in past damages and pre-judgment interest.
    • Kramer Levin Knocks Out Biotech Patent Suit Seeking $530 Million

Kramer Levin secured a complete defense victory for Regeneron Pharmaceuticals in a suit brought by Novartis alleging patent infringement of a biotech patent and seeking $530 million in damages.
    • Kramer Levin Discovery Leads to Patent Litigation Defense Win

Kramer Levin successfully represented Takeda UK Limited in the discovery phase of a foreign patent litigation in the United Kingdom involving a Roche glycosylation patent.
    • Kramer Levin Represents Plaintiff in First Virtual Trial in Federal Court

Kramer Levin is representing plaintiff Centripetal Networks Inc. against Cisco Systems in a multi-patent bench trial that got underway via Zoom, the online video communications platform, due to the pandemic.
    • Kramer Levin Wins Appeal That Allows Sirius XM to Pursue Attorneys’ Fees After Prevailing in Patent Infringement Lawsuit

On Tuesday, April 21, the Federal Circuit vacated and remanded the District of Delaware’s prior order denying Sirius XM Radio Inc.’s motion for attorney fees in the underlying patent litigation Dragon Intellectual Property LLC v. Sirius XM Radio Inc..
    • Kramer Levin Secures Request for Rehearing Win before the PTAB for Sirius XM

The Patent Trial and Appeal Board (the “Board”) has granted Sirius XM Radio, Inc. (“Sirius XM”)’s Requests for Rehearing of its earlier decisions denying four inter partes review Petitions based on Sirius XM’s identification of Real Parties in Interest. Successful Rehearing Requests are exceedingly rare, being granted only about five percent of the time.
    • Centripetal Lead Counsel Switch Leads to Successful Patent Settlement

In a classic example of David versus Goliath, our patent litigation team recently scored a major victory for Centripetal Networks Inc., a small cybersecurity startup, against Keysight Technologies Inc. and Ixia, on patent infringement for four patents that Centripetal owns.
