The Federal Circuit affirmed a Patent Trial and Appeal Board decision that a Finjan Inc. patent for malware protection software is valid. The court also directed the board to review claims of a patent it had decided not to review in a related case, explaining that under the U.S. Supreme Court's April 2018 decision in SAS Institute Inc. v. Iancu, the board may no longer choose which claims it will review. Both cases relate to a 2014 patent infringement suit Finjan filed against Palo Alto Networks in the Northern District of California. Palo Alto challenged the patents at issue before the PTAB in 2015, and the board issued its decisions in spring 2017.
