Intellectual Property partner Mark Baghdassarian and associate Aaron Frankel’s article “Litigation: Avoiding Discovery in Asymmetrical Lawsuits” appears on InsideCounsel.com. The article focuses on the costs of discovery, something savvy plaintiffs use to extract nuisance value settlements before defendants have an opportunity to present their defense. The authors propose defense strategies avoiding discovery all together through early summary judgment in cases where there are very strong threshold defenses.
