We are especially known for our impressive record of success in asserting and defending high-stakes patent cases involving electrical, computer and mechanical (ECM) technologies in court and for our effective advocacy before the Patent Trial and Appeal Board (PTAB).

    Working in multidisciplinary teams, we represent industry innovators including web security companies; computer software and hardware companies; network systems; and satellite, telecommunications, solar power and cybersecurity firms, offering them strategic guidance to give them a competitive edge in the marketplace. In addition to handling bet-the-company patent litigation in the courts, we have a thriving PTAB litigation practice with an extraordinary record of success in inter partes review proceedings. We also work with ECM clients to maximize protection for their innovations through strategic patent prosecution, as well as advise them on the IP aspects of due diligence, licensing and corporate transactions.

    Composed of registered patent lawyers and agents, our IP team holds 38 technical degrees across 22 discrete fields. We understand our clients’ technologies and have extensive experience in protecting and enforcing our clients’ rights in their innovations. Our lawyers are experienced in addressing issues at the intersection of online commerce, social media, entertainment, technology and law, which informs our ECM patent litigation team’s approach and our strategic legal and technical advice.       On Tuesday, April 21, the Federal Circuit vacated and remanded the District of Delaware’s prior order denying Sirius XM Radio Inc.’s motion for attorney fees in the underlying patent litigation Dragon Intellectual Property LLC v. Sirius XM Radio Inc..
    • Kramer Levin Secures Request for Rehearing Win before the PTAB for Sirius XM

      The Patent Trial and Appeal Board (the “Board”) has granted Sirius XM Radio, Inc. (“Sirius XM”)’s Requests for Rehearing of its earlier decisions denying four inter partes review Petitions based on Sirius XM’s identification of Real Parties in Interest. Successful Rehearing Requests are exceedingly rare, being granted only about five percent of the time.
