  • Kramer Levin’s Land Use practice is one of the most well respected and experienced in New York City. With a core group of partners, and support from a cadre of other lawyers and planners, we offer unsurpassed technical knowledge, industry insight and experience.

    Our Land Use lawyers have handled many of the thorniest and most sophisticated land use matters, have represented most of NYC’s leading developers and institutions, and have advised on many of NYC’s megaprojects. 

    Our goal is to help clients add value to their property while minimizing or avoiding the regulatory risks associated with its development and operation. To do this, we work on all the land use aspects of site development in New York City, including: 

    • Due diligence for purchases and financings
    • Counseling as to land use compliance, issues and opportunities
    • Negotiating and documenting development rights transactions
    • Securing legislative, as-of-right and discretionary approvals under the city’s zoning and historic preservation laws
    • Litigating to assert our clients’ rights or defend their land use approvals
    • Handling tax incentive and economic development matters and eminent domain proceedings 

    Our lawyers have obtained public approvals for many of New York City’s highest-profile projects and best-known institutions and buildings, including: 

    • Each of the five supertall buildings at the southern end of Central Park, including One57, 432 Park Ave., Central Park Tower, 220 Central Park South and 111 W. 57th St.
    • The Museum of Modern Art
    • Restorations, enlargements and new construction in virtually every historic district in Manhattan, Brooklyn and Queens
    • Major colleges, universities and other nonprofits
    • Rockefeller Center
    • The Chrysler Building
    • The Empire State Building 

    Many of our team members have served in senior positions in city administrations, where they acquired unsurpassed institutional insight and experience. Our lawyers also hold leadership roles in the Real Estate Board of New York, the leading industry association.

      Continuing our leadership position in providing strategic real estate and land use counsel to some of New York City’s – and the world’s – most recognized brands, Kramer Levin recently partnered with The Walt Disney Co. in its quest both to rationalize its presence in Manhattan and to consolidate its operations into a single location.
    • Kramer Levin Advises Anbang in Connection with Offering Plan and Condominium Conversion of Waldorf Astoria

      For several years, Kramer Levin has represented Anbang Insurance Group in connection with the Waldorf Astoria Hotel. The representation encompasses a number of elements, including matters involving the landmark status of the interiors and exteriors of the historic property, land use aspects, the implementation of an interim ownership structure and, ultimately, the conversion of the property into a mixed-use condominium.
    • The sun rises in the East: East Midtown experiences a renaissance

      Distinct from Manhattan’s West Side in mood, ethos and landscape, the island’s East Side has long been characterized as more conservative and subdued. While there are plenty of historic landmarks here (Grand Central Station, the Seagram Building, Lever House), overall, the effect is a stately, understated urban panorama.

    • Reimagining iconic landmarks: The Waldorf Astoria and the Palace Theatre

      The city that never sleeps is also the city that restlessly reinvents itself. Two legendary landmarks — the Waldorf Astoria at 50th Street and Park Avenue and the Palace Theatre at 1568 Broadway — are undergoing visionary changes. ... Expansion of the Waldorf Astoria will recast it as a mixed-use luxury property that includes a completely renovated hotel, residential condominiums and extensive retail opportunities. Our team represented an affiliate of Anbang Insurance Co., the new owner, on all land use and landmark processes for this extensive reimagining of the original hotel…. Judy Garland raised the roof of the Palace Theatre when she performed there in 1951 for an unprecedented 19-week concert run. Today, it’s the theater’s ground floor that’s getting a lift, with help from Kramer Levin.
