• Cristina L. Martinez litigates complex intellectual property cases, including patent and trademark litigation, with a particular emphasis on technology in the fields of electrical, mechanical and computer sciences.

    Cristina plays a key role on the trial teams in several successful and complex multi-patent cases. She represents Prism Technologies LLC in several patent infringement actions against major telecommunications companies involving access control for wireless networks, and recently obtained a jury verdict of infringement and a favorable settlement after a seven-day trial in two actions pending in the District of Nebraska. Cristina also represented another patent holder as part of a trial team that obtained a jury verdict of infringement in an action pending in the Northern District of California involving antivirus software and computer products.

    Cristina dedicates significant time to pro bono matters. Most recently, she successfully represented before the Board of Immigration Appeals an individual whose application for asylum had been denied. Cristina negotiated with the Department of Homeland Security a joint remand of the case for a new hearing and the opportunity for her client to seek asylum based on his status as a victim of severe child abuse while living in Honduras.

    As a member of Kramer Levin’s Lateral Associate Committee, Cristina represents the firm’s lateral associates in supporting firm goals such as business and professional development, mentoring, and recruitment and retention.

    Experience

    • Represented Nasdaq-listed cybersecurity company Finjan Inc., in a patent infringement suit against Sophos.

    • Represents Prism Technologies LLC in patent infringement actions against the major cellular carriers.

    • Represents the patent holder in a patent infringement action involving security software pending in the Northern District of California.

    • Defended investors against avoidance actions, or “clawback actions,” brought by the SIPA Trustee in connection with the Madoff Ponzi scheme.

    • Defended state governmental agencies in actions alleging civil rights violations under Section 1983 and the New Jersey Civil Rights Act.

    • Conducted internal investigations for financial institutions regarding regulatory violations by current and former employees.

    • Represented a developer against claims brought under the New Jersey Consumer Fraud Act and the New Jersey Planned Real Estate Development Full Disclosure Act.

    • Represented broker-dealers in investigations by FINRA and the SEC regarding violations of state and federal securities laws and regulations.

    • Defended a law firm in a legal malpractice case brought in New Jersey federal court by the receiver of a defunct corporation operated as a Ponzi scheme.

    • Represented a physician association in obtaining reimbursement from insurance companies under state workers’ compensation law.

    • Served as counsel to a federal monitor appointed by the Office of the U.S. Attorney pursuant to a deferred prosecution agreement to oversee the activities of one of the nation’s largest orthopedic device manufacturers.
